Terms of Service

1. Acceptance of Terms

By accessing or using the Mockzilla platform ("Service"), operated by Mockzilla.org ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

On first use, you will be notified of these Terms and our Privacy Policy through the CI/CD integration output. Continued use of the Service after this notification constitutes acceptance.

If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Mockzilla is a hosted API simulation platform designed to help developers and teams test their integrations against third-party APIs. Users upload OpenAPI specifications (and optionally compiled server binaries) through supported integrations such as CI/CD actions, direct upload, or other methods we make available. Mockzilla provisions dedicated simulation servers that serve mock API responses based on those specifications. The primary purpose of the Service is to provide mock and simulation environments for testing, not to host production APIs or serve real data.

The Service is offered in multiple tiers and optional add-ons, each with its own resource limits, features, and pricing. The specific limits and features of each tier are described on our website and may change over time.

User-provided API specifications and simulation data may be stored and processed in any supported AWS region. Organizations may request a specific region, but the final placement decision rests with us. We reserve the right to relocate simulation data between regions for operational reasons.

We may offer pre-built simulations based on publicly available API specifications from third-party providers (e.g., payment processors, messaging platforms). These simulations are unofficial, independently created by Mockzilla.org, and are not affiliated with, endorsed by, or sponsored by the original API providers. All data returned by these simulations is synthetic and generated solely for testing purposes. We make no warranty that these simulations are accurate, complete, or up to date with the original API. Trademarks and brand names referenced in these simulations belong to their respective owners.

3. Accounts and Registration

Access to the Service is provisioned when you connect your repository or upload specifications through any supported integration. By doing so, you create an organization record associated with your source platform account (e.g., GitHub, GitLab, Bitbucket, or other supported platforms).

You are responsible for all activity that occurs under your organization, including all content uploaded and all API traffic served by your simulations.

You must not create accounts or organizations for the purpose of circumventing tier limits, bans, or other restrictions.

4. User Content

"User Content" refers to all material you upload to or serve through the Service, including but not limited to OpenAPI specifications, compiled binaries, static files, and any data returned by your simulations.

You retain ownership of your User Content. By uploading content to the Service, you grant us a limited license to store, process, and serve that content solely for the purpose of operating the Service.

You are solely responsible for your User Content. We do not review, approve, endorse, or verify User Content. We accept no liability for the accuracy, legality, or appropriateness of any content uploaded to or served through the Service.

You represent and warrant that your User Content does not violate any applicable law, regulation, or third-party right, including intellectual property rights, privacy rights, or contractual obligations.

User Content must not contain personally identifiable information (PII), real financial data, health records, authentication credentials, or any other sensitive data. Simulations are intended for testing with synthetic data only. You are solely responsible for ensuring that no real or sensitive data is included in your specifications, responses, or uploaded files.

User Content must not contain or serve illegal material of any kind, including but not limited to content that promotes violence, discrimination, exploitation, or any activity prohibited by applicable law.

5. Acceptable Use

You agree not to use the Service to:

  • Serve, distribute, or simulate APIs that contain illegal content, malware, phishing pages, or any material that violates applicable law
  • Impersonate or misrepresent any real API, service, or organization in a way intended to deceive or defraud third parties
  • Conduct or facilitate denial-of-service attacks, credential stuffing, or any form of automated abuse against the Service or third-party systems
  • Attempt to circumvent rate limits, authentication, tier restrictions, or any other technical controls of the Service
  • Use the Service to store, process, or serve personally identifiable information (PII), financial data, health records, or other sensitive data in violation of applicable data protection laws
  • Upload compiled binaries (codegen mode) that contain malicious code, backdoors, or attempt to access resources outside the simulation sandbox
  • Resell, sublicense, or redistribute the Service without our prior written consent
  • Use the Service in any way that could damage, disable, or impair the Service or interfere with other users

We reserve the right to determine what constitutes a violation of these acceptable use terms at our sole discretion.

6. Service Tiers and Limitations

Each service tier is subject to specific resource limits including but not limited to: request quotas, concurrency limits, number of repositories, number of active refs, specification size limits, and available features.

These limits are described separately for each plan and may be updated at any time. Exceeding your tier limits may result in throttling (HTTP 429 responses) or temporary suspension of your simulations.

Upgrading or downgrading between tiers takes effect immediately. We do not provide prorated refunds for downgrades within a billing period.

7. Payment and Billing

Paid tiers require a valid payment method. Payments are processed by Stripe. We do not store credit card numbers or payment credentials directly.

You agree to pay all fees associated with your selected tier. Failure to pay may result in downgrade to the free tier or suspension of your account.

All fees are non-refundable unless otherwise required by applicable law.

8. Intellectual Property

The Service, including its software, infrastructure, documentation, and branding, is the property of Mockzilla.org and is protected by applicable intellectual property laws.

These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

Your User Content remains yours. We claim no ownership over the specifications, binaries, or other material you upload.

9. Content Removal and Takedowns

We reserve the right to remove any simulation, content, or deployment at any time and without prior notice if we reasonably believe it violates these Terms, applicable law, or poses a risk to the Service or its users.

If you believe that content served through the Service infringes your intellectual property rights, please contact us at the address provided below with a description of the allegedly infringing material, proof of your ownership, and your contact information. We will review all valid requests and take appropriate action.

We are not obligated to restore removed content or provide advance notice of removal.

10. Termination and Bans

We may suspend or terminate your access to the Service at any time, for any reason, including but not limited to violations of these Terms or applicable law.

Users and organizations found to be abusing the Service may be permanently banned. Bans are final and not subject to appeal.

Upon termination, your simulations will be taken down and your uploaded content will be deleted. We are not obligated to provide you with a copy of your content after termination, as all User Content originates from your own repositories.

You may stop using the Service at any time by removing the Mockzilla integration from your repositories or discontinuing uploads.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any responses generated by simulations.

Simulations generate mock data based on your OpenAPI specifications. This data is synthetic and must not be relied upon for production decisions, financial calculations, or any purpose requiring accurate or real data.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Mockzilla.org shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty U.S. dollars (USD 50), whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mockzilla.org from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any applicable law or third-party right.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

14. Fair Use

The Service is designed for typical API simulation and testing workloads. Usage that places an unreasonable burden on our infrastructure, as determined by us, may result in throttling, suspension, or termination of your simulations.

Examples of excessive use include sustained high-frequency automated traffic beyond your tier limits, use of simulations as general-purpose compute, or patterns that degrade the Service for other users.

15. Customer References

We may use your organization name and logo on our website and marketing materials to indicate that you are a user of the Service. If you prefer not to be referenced, please contact us and we will remove your information promptly.

16. Inactive Accounts

We may delete simulations, uploaded data, and organization records for free-tier accounts that have been inactive for an extended period. We will make reasonable efforts to notify you before deletion, but are not obligated to do so.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, corporate restructuring, or sale of assets.

18. Changes to These Terms

We may update these Terms at any time. Changes take effect immediately upon publication on our website.

Your continued use of the Service after changes are published constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.

19. Governing Law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts sitting in the judicial district of Montréal, Québec, Canada.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
